The proposals from different companies were approvedby the State Level Single Window Clearance Committee (SLWCC)headed by Chief Secretary B K Patnaik.

Of the total Rs 3,400 crore investment proposalsapproved by the SLSWCC, Rs 2,870 crore would be in the steelsector, said industries secretary T Ramachandru.

Among other projects, SLWCC approved a proposal fromTata Steel to set up a re-bar mill and a hi-carbon ferrochromeunit at its Gopalpur SEZ in Ganjam district. The steel majorwould invest Rs 800 crore in the project, he said.

The High Court also asked the government to remove all encroachments from the lake and provide adequate protection to primary fishermen of the area to carry on their traditional fishing practices for the purpose of earning their livelihood. These comprehensive directions came from the Division Bench of Chief Justice V. Gopala Gowda and Justice B.N. Mohapatra while disposing of two writ petitions filed in connection with the ongoing controversies of demolition of encroachments in Chilika Lake. While disposing of a writ filed by one Jogendranath Tarai—who had sought for HC’s interference over demolition of an earthen embankment in Chilika by the local administration, the Bench said it was not inclined to interfere in the matter as the same is being done as per Supreme Court’s order.

“We are not inclined to interfere with the demolition activities undertaken by the government for evicting unauthorised prawn culture in Chilika which is in conformity with the judgment of the Apex Court in S. Jagannath V/s Union of India case and the Chilika fishing policy framed by the government of Orissa”, the Bench said.

Similarly, allowing the petition filed by Ambika Primary Fishing Cooperative Society, a registered body of traditional fishermen of the area, the High Court granted much-awaited relief to the local fishermen and directed the government to frame a fresh Chilika policy removing all illegal encroachments within one kilometre of the lake.

“The State government shall take effective steps to ensure that no aquaculture industry or shrimp culture ponds shall be constructed or set up within 1000 mts of Chilika Lake. If such industries are already functioning, the same shall be closed down or demolished forthwith”, the HC said. The HC also asked the local district administration to ensure that all encroachments are removed from Chilika and adequate protection is provided to the primary fishermen, including the fishermen registered under the petitioner cooperative society to carry on their traditional as well as improved fishing for the purpose of earning their livelihood.

State BJP president Jual Oram said the party’s national secretary Kirit Somaiya will make an on-the-spot assessment of the irregularities in the supply of poor quality ‘dal’ (pulses) to children and women under welfare schemes.

Somaiya will visit several districts Feb 7-8. Leaders of the state unit will also accompany him, he told IANS here.

The alleged scam came to light after the state vigilance department last month claimed that there were irregularities in the supply of pulses to children and women at several places.

The vigilance department has not registered any case yet but it submitted a report to the government last week seeking approval to widen the probe.

Oram alleged that the government led by Chief Minister Naveen Patnaik was shielding the culprits involved in the scam.

‘He (Patnaik) has been playing with the lives of millions of children and women in the state by providing them poor quality dal,’ Oram said, alleging that the scam involved a bungling of more than Rs.3,000 crore.

The state government supplies pulses under the mid-day meal scheme, the integrated child development scheme and the supplementary nutrition programme.

On Wednesday, Patnaik met shipping minister G K Vasan in Delhi and urged him to roll back the notification, saying it would seriously affect upcoming ports in Orissa. Immediately after the notification, Patnaik had called it arbitrary and said that the decision would affect 6-7 private ports that are coming up along the northern coast of the state.

Naveen told Vasan that Orissa had, in accordance with law, notified seven non-major ports (Dhamra, Chudamani, Chandipur, Inchudi, Subarnarekha mouth, Bichitrapur and Bahabalpur) in northern parts of the state prior to the revision of KoPT’s territorial limits, overlapping the north Orissa coast.

“This would jeopardise the state’s effort to develop the maritime sector and seriously impact the industrial and economic development of the state,” an official release quoted Naveen as having told Vasan.

“The chief minister expressed his apprehensions. To allay his fears and find an amicable solution, senior ministry officials will hold a meeting with those from the state in 10 days. I have assured him that extension of KoPT’s jurisdiction will not impact the growth of upcoming ports in Orissa,” Vasan said in Delhi after the meeting on Wednesday.

The KoPT had been apprehensive of such a reaction from the Orissa government and turned to railways minister Mamata Banerjee to take up its cause in Delhi. Mamata will meet KoPT officials in Haldia on Friday to discuss the matter. On that day, she will also lay the foundation stone of the Haldia-II port facility that is coming up at Shalukkhali.

The tiff between the Orissa government and KoPT dates back several years when the latter explored possibilities of transloading operations from Cape-size vessels in deeper waters. Large ships of 125,000 tonnes capacity or higher can’t enter the ports of Kolkata or Haldia due to low draught. Transloading was attempted at the Sandheads beyond Sagar but this was possible only during the fairweather season (September to February).

KoPT then set its sights to a silted area’ off the Orissa coast where transloading of cargo was possible throughout the year. The proposal is to anchor a vessel at this point permanently and offload cargo into it from larger vessels. This cargo would then be loaded on to barges and taken to the ports of Kolkata and Haldia.

The Orissa government had been against this move from the start. Patnaik has pointed out that the port facility being set up by the Tatas at Dhamra will be the worst affected. According to sources, Dhamra’s future depends on transloading cargo from larger vessels and shipping it on barges to ports like Kolkata and Haldia. Read more….

“The process for environmental clearance has to be started de novo,” said an affidavit filed by the Union Ministry of Environment and Forests (MoEF) in the Orissa High Court in response to a writ petition by Vedanta Aluminium Limited (VAL) challenging the stalling order.

VAL in August 2007 had applied for expansion of its Lanjigarh-based existing refinery capacity from 1 to 6 MTPA and captive power plant from 75 to 300 MW. But pending environmental clearance from MoEF, the company went ahead with construction work for its six-fold refinery and four-fold power plant expansion proposal.

Exercising powers under Environment (Protection) Act1986 and Rules thereof, the MoEF in October last year had ordered the company to maintain status quo at the plant site and also withdrew the terms of reference (ToR) issued to the company in March 2009 for expansion.

Canceling the public hearing conducted by the company with respect to expansion project, the MoEF had also directed the Orissa Forest and Environment secretary to take legal action against the company for violating Environment Impact Assessment (EIA) notification of 2006.

However, challenging the MoEF order, VAL had moved the Orissa High Court through a writ petition and at the same time moved the ministry in at least three letters written in the months of October, November and December 2010 requesting for withdrawal of its October 20, 2010 directions.

Responding to the notices issued to it by the HC pertaining to VAL writ, the MoEF said that the requests of the company have been duly examined and under statutory provisions the violations committed by the company have been referred to Expert Appraisal Committees (EACs) for consideration on the merit of the proposal.

“In the case of VAL, the appraisal process was not completed. As the petitioner had violated the provisions of EIA notification of 2006, final direction were issued for withdrawal of terms of reference as well as cancellation of public hearing conducted in April 2009. The process of environmental clearance has to be started de novo,” the MoEF affidavit said, adding VAL was requested on January 11 to submit the fresh proposal to the ministry for obtaining environmental clearance for its expansion project.
